FoodFOMO Privacy Policy How we collect, use, and protect your personal information Version 2.1 — Replaces all previous versions Effective: 6 July 2026
IMPORTANT: This Privacy Policy (Version 2.1) replaces FoodFOMO's previous Privacy Policy in its entirety. Version 2.1 adds the disclosures for FoodFOMO's social features (friends, messaging, and polls). The previous version stated that FoodFOMO was an anonymous app that did not require an account or collect personal information. That is no longer accurate. FoodFOMO now requires user accounts and collects personal information as described in this Policy. By creating an account or continuing to use FoodFOMO after the effective date of this Policy, you acknowledge and accept the terms of this updated Policy.
FoodFOMO is operated by FoodFOMO (ABN: 23 489 336 470), based in Australia. We are committed to protecting your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Account information When you create a FoodFOMO account, we collect your email address and, if you sign up with email and password, a hashed (encrypted) version of your password. If you sign up via Google or Apple, we receive your email address and a unique identifier from those services. We do not receive or store your Google or Apple password. Photos you upload If you upload Food Memory photos, those photos are stored on our servers and may be visible to other FoodFOMO users. Photos may contain embedded metadata such as the date and device they were taken on. We recommend removing sensitive metadata before uploading if privacy is a concern. Messages, friends and social activity FoodFOMO includes social features. If you use them, we collect and store: the messages you send and receive in direct and group chats (including text, spots you share, and polls you create or vote in); your friends list and friend requests; your public username (handle); and reports you submit about other users' content. Messages are stored so they can be delivered to and displayed for the people in a conversation. Do not share sensitive personal information in messages. If you choose to use the "invite a friend" feature, it simply shares a standard FoodFOMO link — we do not access your device contacts. Location data FoodFOMO requests access to your device location to power the Near Me feature, which shows you trending venues near your current position. We may collect both approximate location (city or suburb level) and precise location (GPS coordinates) depending on your device settings and the permissions you grant. You can withdraw location permission at any time through your device settings, though this will disable the Near Me feature. Usage analytics We collect anonymised or pseudonymous data about how you use FoodFOMO, including which venues you view, which cities you browse, how long you use the app, and features you interact with. This helps us understand and improve the app experience. Device identifier We collect a unique device identifier to help us distinguish between devices, prevent fraud, and maintain the security of the platform. Information you provide voluntarily If you contact us for support or report a content issue, we may collect the information you provide in those communications.
We collect and use your personal information for the following purposes:
FoodFOMO may send you a weekly email report featuring trending venues and food discoveries in your city. We will only send you marketing emails if you have given us your explicit opt-in consent at the time of account creation or through your account settings. Every marketing email we send will include a clear and functional unsubscribe mechanism. You can also manage your email preferences at any time from within the app under Settings. Once you unsubscribe, we will stop sending marketing emails within 5 business days. We comply with the Spam Act 2003 (Cth). We will never send you unsolicited commercial electronic messages.
Service providers We share your information with trusted third-party service providers who help us operate FoodFOMO, including cloud storage and database providers, analytics providers, and email delivery services. These providers are only permitted to use your information to provide services to FoodFOMO and are required to protect it. Sign in with Google and Apple If you use Sign in with Google or Sign in with Apple, your authentication is managed by those providers under their own privacy policies. FoodFOMO only receives the minimum information needed to create and maintain your account. Other FoodFOMO users When you use the social features, the content you choose to send — messages, shared spots, polls, and your username — is visible to the other people in that conversation or to friends you interact with. This is an inherent part of how messaging and friends work. Social platforms FoodFOMO surfaces trending content that originates from TikTok and Instagram. We do not share your personal information with TikTok, Instagram, Meta, or ByteDance as part of the trending content features. Legal requirements We may disclose your information if required to do so by law, court order, or government authority, or where we believe in good faith that disclosure is necessary to protect the rights, property, or safety of FoodFOMO, our users, or the public. Business transfers If FoodFOMO is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information is transferred and becomes subject to a different privacy policy. We do not sell your data FoodFOMO does not sell, rent, or trade your personal information to any third party for their own marketing or commercial purposes.
We retain your personal information for as long as your account is active. If you delete your account, we will delete or anonymise your personal information within 30 days, except where:
We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These steps include encrypted data storage, secure transmission protocols (HTTPS), and access controls limiting who within FoodFOMO can access personal data. However, no method of transmission or storage is 100% secure. If you believe your account has been compromised, contact us immediately at hello@talkmate.com.au. In the event of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme under the Privacy Act 1988.
FoodFOMO is strictly for users aged 18 and over. We do not knowingly collect personal information from anyone under 18. If we become aware that a user is under 18, we will immediately delete their account and all associated data. The FoodFOMO web app uses cookies and similar technologies to maintain your session, remember your preferences, and collect usage analytics. You can control cookie settings through your browser, though disabling certain cookies may affect app functionality.
FoodFOMO has zero tolerance for objectionable content or abusive behaviour in messages, photos, and other user-generated content. Every user must agree to our Terms of Service, which prohibit harassment, hate speech, and other objectionable content. Within the app you can:
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email or via an in-app notification before the changes take effect. The updated Policy will show the new effective date at the top. Your continued use of FoodFOMO after the updated Policy takes effect constitutes your acceptance of the new Policy.
This Privacy Policy is governed by the laws of Australia. Any disputes arising in connection with this Policy will be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia.
